CO Issues Guidance and FAQs Regarding Real Estate Brokers and Other Service Providers Under the Safer at Home Order

The Colorado Department of Regulatory Agencies recently issued guidance to real estate brokers and other service providers to clarify and synthesize industry-specific measures under Colorado’s new Safer at Home phase of the COVID-19 pandemic.  Among other things, the guidance clarifies that marketing services and real estate showings are permissible, subject to restrictions, unless the local jurisdiction is under a Stay At Home Order.

The guidance also includes FAQs addressing, for example, (i) whether a brokerage firm can reopen offices and what obligations are imposed upon reopening, (ii) reconciling various stay at home orders from various applicable agencies and/or jurisdictions by following the most restrictive terms, (iii) the requirement to have written COVID-19 policies in place, and (iv) the procedures and requirements for showing property.
